Die Selbstverpflichtung der Schweizer Diözesen im Umgang mit Missbrauchsakten

Abstract

In 2022/23, the Swiss Bishops' Conference, the Römisch-katholische Zentralkonferenz and the Association of Religious Orders commissioned a study about sexual abuse cases in Swiss dioceses, ecclesiastical bodies and religious orders. The study criticised the erasure requirement of c. 489 § 2 CIC/1983. In the following, the organisations signed a voluntary commitment to deal with abuse files. This contains the obligation to no longer apply c. 489 § 2 CIC/1983 in future. This article examines the legal nature and content of the voluntary commitment and identifies ways in which a direct confrontation with universal law could have been avoided.
